Let mvba help you protect your delinquent tax revenue from bankruptcy.

When bankruptcy reorganization plans are drawn, taxing units can get left out in the cold when they don’t have an advocate. That’s where we come in. We aggressively protect our clients’ interests in the bankruptcy courts. This diligence results in the timely collection of debt, which might be otherwise lost or inordinately delayed.

Our attorneys make more personal appearances before bankruptcy judges than any other property tax collections firm.

Upon request, our Bankruptcy Practice Group is qualified to serve as local counsel for out-of-state attorneys in any bankruptcy case or proceeding pending in Texas’ Western, Eastern, Northern and Southern Bankruptcy divisions. We have served as local counsel in such high profile bankruptcy cases as Westmoreland Coal Company and Cloud Peak Energy, Inc. Our bankruptcy practice area spans across Texas and we have a long-standing presence in the local legal community.

Our bankruptcy attorney is licensed to practice in the following Federal Bankruptcy Courts:

  • Alaska
  • Arizona
  • Carolina
  • Delaware
  • Florida
  • Georgia

In bankruptcy cases representing secured creditors, we’ve utilized and implemented a host of creditors’ remedies, including:

  • Debtor in possession financing negotiations
  • Motions for relief from the automatic stay
  • Opposition to cash collateral
  • Opposition to confirmation of plan
  • Adequate protection in sale transactions

Timely response to motions filed by debtors or competing creditors

Our experienced bankruptcy team file comprehensive proofs of claim for tax and non-tax debts in all bankruptcy filings – Chapters 7, 11, 12, and 13. We are licensed to practice in federal courts across the country and provide nationwide representation for our clients.

Proprietary bankruptcy tracking & filing software

We have designed, developed and refined our own in-house system to expedite recovery of potentially lost tax revenue. With it, we have made it easier to prepare suits and bankruptcy claims because all the title work is collected in one database from which we generate court-ready documents for filing.

Proactive filing of motions to accelerate the resolution of bankruptcy cases

We also prepare and file Notices of Appearance to advise all participants to provide us with copies of relevant paperwork so we may respond appropriately on your behalf. When appropriate, we move for a modification of the automatic stay, which would otherwise bar the pursuit of taxes by lawsuit. When we are able to do this, we may subsequently seek the payment of the taxes due in a state court action.

Review of Chapter 11 & Chapter 13 bankruptcy reorganization plans

We keep tabs on all reorganization plans and related transactions to make sure our clients maintain full legal redress.

We work to protect your property tax liens & obtain priority payment of taxes.
